Hello there!

I was involved in a motor vehicle accident involving three cars, the person found at fault fled the scene, my HMO paid for the ambulance bill but now they sent me a questionnaire asking me about details of the accident because they say they can get reimbursement from my own car insurance or other party, since the person at fault is considered hit and run, can my HMO take money from my Underinsured Bodily Injury? I dont think it is fair that I will have to end up paying my own HMO for my medical bills. I live in the state of California and I dont know if subrogation is applicable in this case...thank you

Thank you for the question. Hopefully you don’t, but if you do have resultant injuries, I wish you a speedy and full recovery.

First of all, it’s not fair that your HMO has to incur the cost either since you weren’t at fault but that is why we have insurance. I would encourage you to continue to maintain it as the economy has caused for many to forego liability coverage and more and more people are uninsured as a result.

As for subrogation; without reading the policies I can’t opine who has the right to do what.  As for your HMO seeking recovery, this would be a contract issue and you may ask them where in your policy it gives them the right to seek recovery; but if it were I, I would let the two insurers deal with it as your auto carrier won’t merely pay unless they must and if they aren’t obligated…they won’t. Don’t worry about it…this is why you have insurance and you have a vehicle to be concerned about.
