Auto Insurance Claims: city bus accident, workers compensation claim, defence attorney

In Dec 05 i was parked when car was hit by city bus. She claimed i was parrallel parking & i was not, i was parked. The front of my bumper was pulled off my car & @ the time of the accident the driver said she was fine & nobody was hurt. Well she changed stories & claimed injury when i saw she perfectly ran & walked w/no problems. My insurance company says is still waiting on finalization of the workers compensation claim & because no law suite has been filed by the bus driver or compesation insurance...they can't subpoena any information. What are my rights. My witness would only give me an address & won't respond to letters sent. Any advice of what my rights would be i would appreciate it. My state is California. Hi Lily,

This is not a question of "Rights". Your insurance company is conducting an investigation. They will help determin who was responsible for the accident. If you do receive suit papers, you should contact your insurance company immediatel;y. They will provide a defence attorney to handle the case.

Once all of the facts come out, the case will be settled one way or another.
