Auto Insurance Claims: auto theft, juris doctor, auto theft

Question
my car was stolen at a pay parking lot. i had liability on my car and from what ive been told it was probably a inside job. the thief paid 15 dollars to take my car out of the lot. i want to know if my insurance (usaa) would cover the car. also would i be able to sue the parking lot?

Answer
Hi Owen,

Sorry Dr. Settlement was one of the one million in WA without power until today, hence the delay in getting to my e-mail.

Yes, to both, assuming there is something in the area of comprehensive on your car in addition to just liability.  If that is all you carry, then USAA has no obligation whatsoever to you.

If you have no insurance, then your suit versus the parking lot will be for the full value of the loss.  Otherwise, if you did have some comprehensive, then
your only damages to sue for would be your deductible and any losses not covered by insurance.

There would be a separate cause of action if you can prove that the attendant looked the other way while he let someone take your car.  Ignore the legal limitation printed on the parking stub.  If they were involved, then they are liable.

Best wishes,
