Auto Insurance Claims: third party claims, joint custody and personal injury, legal answer, atorney

My question is this.  When you have a claim for a minor child that the parents have joint custody and there is a warrant in debt for the hospital and one parent refuses to cooperate, what can the other one do?  Is there a way to force the other parent to comply so that the claim can be settled?  The insurance company is ready to settle the claim.  One parent says there may be outstanding claims for additional personal injury monies, but no concrete evidence.  What are my options?  I want this claim settled before the hospital gets a judgment against me.  How can I get my ex-husband to comply and sign for the settlement for the hospital claim?
