Auto Insurance Claims: do i have to accept the offer, state insurance commissioner, small claims court

i was hit and i went and had my coustom ram van looked by 2 body shops and got prices to fix one was at 2300 with out running boards and another was 2400 with out   the running boards cost 699 (only one needed) each!  the persons insurances company told me they would fix at there shop or pay me 490 this sounds wrong do i have to fix at there shop or do i have choices ?

You are entitled to get the vehicle fixed at the autobody shop of your chooing.  Call your state insurance commissioner http://www.settlementcentral.com/links.php

With that litte amount at stake, you qualify for your local small claims court.  Pay the $35 and just file a lawsuit. It is easy to do on a form.

No attorneys can appear in that court, as the issue will be decided by the testimony of just the two of you.  I can guarantee you that you will get the bill paid at the shop of your choice once that adjuster has to explain to her supervisor why this claim could not be settled.

OR--use your own company to pay for the repairs, and let them go after the tortfeasor's company for both the amount spent PLUS your deductible.
