Auto Insurance Claims: Question, medical documentation, insurance company

2 years ago my then 16 year old daughter was involved in an accident deemed her fault.  Today (now 18) she was served with papers that she was being sued.  I talked to the insurance company and they are hiring a lawyer and they will take care of the papers.  The plaintiff has not turned over medical documentation so that the insurance company can settle the claim.  If this goes to court do I need a separate attorney.  The insurance company says the lawyer they hire will represent my daughter.  My daughter is still on my policy and is in college now

You should ask your insurance company to keep you informed of any demands that come in from the other side. If the demands made are well within the limits of your policy then you should not need another attorney. However, if the demands exceed the limits of your policy then you may bneed your own attorney to represent you the any amounts in excess of your policy limits. The attorney hired by your insurance company should contact you to discuss the case. At that time you can ask him or her if they think it will be necessary for you to hire another attorney. The most important thing is that you are kept in the loop of what is going on. However, do not expect a weekly or even a monthly update. Sometimes these cases can drag out for many months or even more than a year. You should seek an update say every 60 to 90 days.
