Auto Insurance Claims: Someone hit my car, while parked, claims advice, claim help

Question
My car was parked while I was inside and someone backed up into my car. They came in to let me know and we gave each other, each other's information. The woman later called me saying she had contacted her insurance, and they would give me a call. Well it has now been 3 days since they backed up into my car. What other actions should I take? Do I need to call my insurance company to make sure they were notified by her company?

Answer
 Hello Dimarie,

First thing, in my opinion it is highly unlikely that the at fault's insurance company is going to call you.  It is your responsibility to call them immediately so that you can file a property damage claim against the woman's policy.

As far as your insurance company, they have no involvement.  They will not file your claim for you.  The only potential involvement your company could have would be if the woman changes her story and her company denies your claim refusing to pay for your damages. In that case you would have to do one of three things.  If the damage is minor, the cost to repair could be less than your collision deductible.  In that situation, you would probably want to pay for the damages yourself. If the cost to repair is greater than your deductible, you would file through your collision coverage, however you would have to pay your own deductible.

If you do not have collision coverage, you would be on your own.  Your only other option - and we're still working on one assumption that the other driver is denying the incident - would be to sue her in small claims court for your damages.  Your chances of success, however, would be slim if she continued to deny involvement.

In view of the circumstances, assuming she is being truthful, her company should pay for your property damages, and you should be able to avoid all this aggravation.

A word of advice - NEVER leave the scene of an accident, no matter how minor, without filing a police report on the scene.

Hope this helps.  Good luck!
