Towing Issues: Towed in Tampa, small claims court, tow company

I park everyday in daily pay privatly owned lot in tampa. You pay in machine and put slip on dashboard. I was towed the other day. The said one of my tires was over the white line and considered as double parking.  Chrgd me $169. Is this legal?

Well I would of asked to see pictures of the violation, so that you could establish the reason for the tow. If you were in 2 spaces then yes it would be a legal tow, but how far over would be a question..

1/2 an inch,  1 foot,  somewhere they have to have a line drawn where you are penalized by the tow.

Till then it is "he said, they say, you say" issue.

Remember that you can look at it as if you were in court.  Where is the proof, where is the evidence?
You always have the right to take this to small claims court and present your evidence in front of a judge and they would have to present theirs also. That would include pictures of "YOUR VEHICLE" over the line, in which it establishes the identity of the vehicle. That means to me and most likely a judge, pictures which clearly show the violation, and your vehicle in the pictures along with your license plate.

Just a picture only of a tire over the line, could be looked at as any vehicle in the world being used to show that. There has to be more proof than just that.

Talk to the tow company and ask for proof of the violation, and most will help you with that part as in many areas now they are required to take pictures of the violations before towing.
