Towing Issues: Towing laws: Idaho, graveled road, staff cut

My son ran off a graveled road at 3:00 am.  He walked to a friends house with the intention of returning for the car in the morning to get it out of the ditch.  Someone reported the vehicle to the police and they came to my home and notified me at 10:00 am that the car was being towed.  Upon request from the officer my son went to the scene to meet the officer.  By the time he arrived the car was in the process of being towed and the officer hadn't arrived. Did they have the right to call the tow truck without giving me the opportunity to retrieve the vehicle myself?  It was not on private property and it was not blocking the road.  No other vehicle was involved.

Well in reading the question I do have a few concerns here.

First of all, your son was driving a vehicle on a roadway when he had an accident.
Then he walked away from the vehicle and did not report it to anyone including the police.
That can be and usually is HIT AND RUN..

Now the officers  generally respond to a call about a car in the ditch and they most likely  had fire or medics respond to the location in case there were injuries.
And since this is in Idaho, I am guessing that this a bit rural area and that usually means that officers at times order tows before they get their and do the investigation. Thats a very common issue now with staff cut backs and stuff within law enforcement.

Now after finding the vehicle unattended and involved in a wreck with property damage most likely they did an investigation and also were in the process of towing the vehicle for safe keeping. That is usually done and a hold is placed on the vehicle till they get to talk to the person driving the vehicle and they either decide at that point to give tickets or worse.

Now does all that sound about like what happened and you were told by the police and your son ?
