Towing Issues: Disabled Parking on Private property, disabled parking spaces, california dmv

In California. Can an HOA on private property enforce restrictions to the disabled
parking spaces in the community. IE designate for Guests of residents only all
others will be towed. If signs are posted, spaces are clearly marked and CCRs
reflect such rules.

Well Brett, I know that California has some strict laws regarding handicapped parking issues and they also have a lot of provisions in the DMV laws regarding parking in HOA's, which are basically a "private city" in effect...

As I have researched some of the laws regarding the HOA issues and regulations, I have also found out that each and everyone has a different set of rules and regulations and as such it makes it hard to really handle the questions regarding them...

But I would suggest that you check with the California DMV for information on this issue as after all, "disabled permits" fall under state and federal laws also...

It gets real complicated at times as to what is allowed or legal, and then throw in private property parking issues and you can see the issues.

But if I had to say a definite answer, I would tend to be agreeing that as long as you meet the state requirements for the permit and the usage of it, then the spaces should not be "tenant only" or "Guests of tenants only"

But that is my thoughts on the issue.
