Towing Issues: hoa towing, deed restricted community, tow companies

I live in Windermere Florida in a Deed restricted community. It is gated and cars are not allowed to be parked on the streets over night.  Our president of the hoa wants to start a "rolling towing"  He wants to pick the hours and have it enforced.  Where do the homeowners stand.  In the past a sticker was placed on the cars as a warning?  I have been told a rolling towing is generally not good- companies can show up and tow prior to the time that are set.  Any thoughts??

Kim, I am at a quandary about this post and how to answer it...


I understand that the HOA wants to enforce rules and regulations concerning parking, and towing is one of the most common ways to do this...

Yes you are correct that "patrol or roam" towing, is very problem laden and as such it causes lots of problems...

If there is a "TIME FRAME" for where vehicles can not be parked on the street, lets say for example 11pm to 6 am, the differences between everyone clocks does create problems.  One way I have seen done and it works, is for the prohibited times to be like 11 to 6 and the towing from midnite to 5 am... That way there are no "1 or 5 minutes of error"

If the HOA wants to do this kind of towing, I would suggest that they also check around with several different tow companies and see which one is better and will follow the rules... After all it will come back to the HOA if the tow company does things illegal...
