Towing Issues: car towing laws in boise idaho, tow companies, conspicuous location

my car was towed on friday night from my friends apartment. without any notification. i stayed there due to the fact that my child fell asleep and didn't want to take him out in the cold. my question is, is it legal for the towing company to refuse to allow me to get my car back until tuesday. and is it legal to keep me from getting things out of my car such as a car seat for my child so that i can find a way to get home.

TITLE 49 MOTOR VEHICLES CHAPTER 18 ABANDONED MOTOR VEHICLES 49-1806. REMOVAL OF UNAUTHORIZED AND ABANDONED VEHICLE FROM REAL PROPERTY.

(1) Any person having possession or control of real property who finds an unauthorized vehicle standing upon his property is permitted to have the vehicle removed if there is posted on or near the property in a clearly conspicuous location, in large print, a sign or notice that unauthorized vehicles will be removed at the owner's expense and designating the name of the towing firm. Unauthorized vehicles need not meet the provision of section 49-102(2), Idaho Code, in this instance.

Well that covers the "notification" part.. Signs need to be posted at the entrances of the complex..

Now as to the getting the vehicle out "after hours" that can usually happen.. But there is an "after hours release fee" or "gate fee" which is usually charged for this which adds to the total fees charged...
This fee also applies when you want to get things like keys or car seats out anytime other than normal business hours..

With Monday being a "Federal Holiday" then you would have to wait till Tuesday till you could pick up the vehicle under normal business hours..

Tow companies are private business organizations and as such set their rates and policies especially when dealing with "PRIVATE PROPERTY TOWING ISSUES"... In some areas I know there are City rules and regulations and I could not find anything on a quick search of information...
