Towing Issues: Parking and towing from Visitor Parking, question pool, visitor car

Hello,

First of all, let me express my appreciation for your answers in this forum.

I live in a Apartment Complex in the Bay Area ( San Mateo, CA ), where we have 3 type of parking spots, "Resident Assigned", "Visitor Only" and "General Use". Recently they started towing cars from the "Visitor Only" spots, where they believed it was a car parked by a resident. There was/is NO official car registration for residents ( we were not required to fill in any form with the data of the cars we own ), so I wonder how they "know" which car is a visitor car.
This is especially troublesome, as most of the "General Use" spots are filled with "unknown/visitor" cars, leaving no empty spaces for residents, only in visitor parkings...

Is this legal? Can they tow vehicles from Visitor Spots without knowing - legally - if they are "resident" vehicles?

Any advice, please?

Sorry that this question is delayed in getting answered, I just found a question pool area in which we are not notified of questions..

Ok, in my experience in towing from private property it is easy to figure out who tenants are and who are visitors.. Tenants tend to have the same vehicle each night in a space...

As to towing from visitor spaces, well California (at the time this question was asked ) had some big loopholes in laws regarding towing from private property... They have since been tightened up with the new rules that took effect Jan 1 2007.

But my question is why are residents not parking in their assigned spaces, or is there only 1 assigned space for each apartment and as a result of having 2 vehicles they park in visitor or general use spaces..

My suggestion to your apartment is that it would be wise for them to start a permit system for parking and identification of resident vehicles.. It would most likely solve some headaches and money...
