Trucking: Truck Brokerage, due dilligence, truck brokerage

I am doing research for a potential insured.  Insurance companies advise that brokerage presents unique problems in that the courts are finding with increased frequency the broker is being held responsible for accidents alledging they did not do their due dilligence when contracting with the carrier.  Do you have any info on this or can you point me in the direction of references I might consult.

There is a thread of liability that extends to the Broker if the Trucker will not or can not settle the claim the Broker in some cases may be held liable. A Broker may purchase contingent liabilty to protect themselves if they have this coverage they will have a insurance cert. to prove it. I would advise that it be for atleast $1,000,000
