What is the Penalty for Driving on a Suspended License in Massachusetts?

If a Massachusetts driver’s license has been suspended for any type of driving violation, the state law says the driver can't operate a vehicle under any circumstances. The penalties start with fines, but it is possible that a person caught driving with a suspended license can find himself in jail.

First Offense

  • The minimum fine is $500 and the maximum $1,000 for a first-time conviction. The driver could also get up to 10 days in jail, but the exact amount of time is up to the discretion of the court. The state could also increase the length of the original suspension. The extension usually ranges from 60 days to one year.

Subsequent Offenses

  • After the first conviction, the fine jumps to $1,000 to $10,000 depending on the severity of the original suspension. A jail sentence of 60 days to 2 1/2 years. Habitual traffic offenders who drive with a suspended license face a fine of $500 to $5,000, up to two years in jail, or a combination of both. If the license was originally suspended for a drunk driving offense, the driver gets a mandatory one year jail sentence.
