How do I Sell a Car That Won't Pass California Emissions Tests?

Your car must pass the California emissions biennial smog test every two years. A car that cannot pass the smog test becomes a financial liability. You do have several options for legally transferring title and gaining some financial compensation. Consider selling your car online to an out-of-state buyer from a state with more lenient emissions standards. Some rural areas do not have emissions requirements.

  • Sell the car out of state. A car that does not pass California emissions rules may pass somewhere else. Research car sales rules for the buyer's state and California to ensure that the sale meets all legal standards of each state. Check with your local Department of Motor Vehicles for how to obtain a temporary license plate or registration tag required to drive the vehicle out of state.

  • Sell the car to a parts dealer or salvage yard. Junk yards throughout California will buy your vehicle for cash and make money off the parts. You can also sell it to out-of-state parts dealers. Make sure the purchase price includes towing and immediate cash payment.

  • Retire your car through a state program. The Bureau of Automotive Repair, California Department of Consumer Affairs, offers $1,000 to retire your vehicle and have it dismantled. Fill out the Consumer Assistance Program Application. Your vehicle must meet specific equipment and operational requirements to qualify for the program.

  • Donate the car to charity. Many local and national charities will provide free towing and provide a receipt for a tax-deductible donation. Notify the charity of the make and model of the vehicle to be donated, arrange for a free pickup and receive a tax write-off. Inform the charity that the transferable title will be for a vehicle that cannot pass California emissions rules.
