Auto Insurance Claims: insurance payment, insurance payment


Question
An at fault driver has the state minimum coverage of $10,000.
He hits two cars, one has $6,000 in damage the other has 12,000.
How is the 10,000 split among the victims?

Answer
It depends on your state. Most likely, (majority rule) a pro rata portion of damages will be paid. The one with $12,000 will get more than the other, but they both will recover something.

Of course, if there is collision and/or Uninsured/underinsured motorist, there will be coverage, that coverage should be triggered to protect you.

Also remember that some states allow "limit stacking", which could allow the driver to stack the limits of two vehicles on his policy (10K + 10k), you need talk to a local lawyer about that.
