Auto Insurance Claims: Safeway auto insurance, insurance expert

Question
I was a passenger in a auto accident. My friend was in the wrong. So I'm sueing her insurance. No my question is if I settle can I pay my own medical bills wit my money the insurer owe me

Answer
Hello Kimuada,

I'm a bit confused with your question, nor do I know what state you reside in. If you are in a no fault state, your coverage would pay for your injuries regardless of fault.  If not, you can file a claim against your friend's policy for your injury losses.  A suit is not necessary.  The claim would come first.  Assuming of course, that there is liability coverage.

If you are actually suing and not simply filing a claim, unless the court determines otherwise, you can you certainly use the settlement to pay your medical bills as this would be the reason in the first place for the suit.
