Auto Insurance Claims: allstate death benifit, insurance benefits, life insurance benefits

hi i am the exector of probate in califorina where the insured was killed in an auto acc. she was insured with allstate and the person who caused this accident was insured with mercury ins. and was also killed. my person Kim had no relitives  but did leave a will with four benifishires. there is a 250k wrongful death coverage in her poilcy but allstate refuses to pay ststing that its only for relitives. Kim knew when she purchased this policy she had no relitives and just had benifishires .Should allstate have to pay this wrongful death benifit to the non related people or not  thankyou for any help you can offer.

If I reading your question correctly, you are dealing with a life insurance policy, not an auto insurance policy.  In either case, only the terms of the insurance policy dictate whether or not benefits are extended.

You will need to have a copy of that policy, and you will need to read it to determine if your friend has benefits that will extend to non-relatives.  

Insurance policies are supposed to be written in clear language so that consumers can understand them.  However, if you cannot understand the policy, you can request that Allstate provide you with the specific section of the policy that applies.  If you do not have the policy, have Allstate send you a copy.  You are entitled to it as her executor.

Also, check to see if you have a copy of her Declarations page.  That page should specify her particular coverage, and may include other valuable information for you.

In a worst case scenario, you would have to obtain an attorney to clarify the policy benefits for you.  If there us coverage for non relatives, the attorney would be able to take legal action if necessary.  This might begin with a demand for payment from Allstate.
