Auto Insurance Claims: Claim, colorado, non-cooperation

recently, a truck backed up and hit my car, the damage to the car was not that severe so I didn't call the police, I got all his insurance information and took photos an all. I filed the claim with his insurance USAA but their telling me that he is not answering the phone or the latter. And suppossibly if he does not answer they are going to close my case.
What can I do?

  Unfortunately the insurance carrier can do this.  What you must do is pursue the individual directly.  If the individual will not cooperate, then the insurance company does not have to pay.  When I was faced with this dilemma, I simply tracked down the individual, and gave them a ring advising that I would be forced to sue if they did not provide a statement to their carrier.
