Auto Insurance Claims: Rear End Accident, steering wheel, demand letter

Question
I was rear ended in December 2009 in Missouri City, TX. My damage was about 400.00. When I was hit my head hit the steering wheel. I ended up going to physical therapy. I went a lawyer and they sent a demand letter along with my medical records from the physical therapy. State Farm sent them a letter denying the bodily injury due to damage of the car was not significant. Since State Farm denied the claim the lawyer drop me. What other steps can I take outside of the lawyer can I get compensated for my injuries from State Farm?

Answer
Hi Lonnie,

What State Farm is saying is that the damage to your car was so minimal that the impact could not have cause any injury. Being hit from behind it is also hard to imaging how your head hit the steering wheel which is located in front of you.

When making a claim to an insurance company it is up to you to prove your case. The only thing you can do now is to file a law suit against the at-fault driver. State Farm will hire that person an attorney. You will then have to prove to a judge how your injuries occured and why you needed medical treatment.

I hope this helps
