Auto Insurance Claims: sideswiped my car and wont take responsibility, liar liar pants on fire

Question
I was driving in the right hand lane and a Honda Civic was driving in the left hand lane and changed lanes right into my car.  It seemed so obvious to me the damage was inflicted by her car yet the insurance company (Geico) says even with pictures it can't be proved!  So now I am stuck with a $500 deductable to pay for the damages on my own car. Is there anyway I can get sometime of "real time" footage for that particular street at a certain time or do you have any other suggestions?  The young lady has been told by her parents to lie about hitting me (she claims the opposite)and I just think its terrible to be so dishonest.  Plus I am a single mom and don't have $500. This is an unjust situation.  Please help.  Thank you so much

Answer
Gloria,

Unfortunately, this is a common situation.  In most cities, the city traffic department can advise as to whether there are cameras at a certain location.  Unfortunately, most of the city cameras are just being monitored for traffic news and do not record to a tape/disk.  The other option is to canvas the area where the accident occurred and look for convenient stores, banks, atms, private businesses and so forth, many of these places will have surveillance cameras from which you may be able to get footage.

The traffic laws in each state are a little different, and most of the time, it is the person in the right hand lane that is supposed to yield to the person on the left, so that probably won't help you.  The last option you have is to spend $100.00 instead of $500.00 to pursue the other party directly in small claims court.  Liars never win, it is easy to spot a liar when they have to be sworn in and give testimony, and it is almost unheard of for a jury to side with a young female driver.  Depending on where you are located, the small claims process is normally very simple and just putting that pressure on the other driver will likely make her insurance company just settle the claim.

I hope this helps!  You have a tough situation with no easy fix.
