Auto Insurance Claims: auto accident, vehicle owner, insurance company

A friend of mine was in a accident that wasn't his fault.here the question.the owner of the other car told his insurance company that the driver was not permitted to drive his car. but the owner did not report the car stolen.his insurance company said they will not pay for damages.thank

Hi Larry,

This may depend on the state that you're in but to the best of my understanding, in order to claim non-permissive use, the vehicle owner must press charges against the person who took the vehicle. If the vehicle owner is not willing to press charges, then the insurance company can not deny coverage. If the insurance company continues to deny coverage then you may want to consult with an attorney.
