Auto Insurance Claims: got in an accident with an illegal, fender bender, legal secretaries

My fiance got into a fender bender at the park last week. the driver of the other vehicle was an illegal ailen without any drivers license or id.
the car and insurance is in my name and i didnt file a claim at all... the guy isnt even legal... now my finace got a call from the drivers girlfriends insurance company regarding the accident.
can they actually pursue any damages for this accident if the person involved isnt legal?

Hi Stacy,

Don't EVEN get Dr. Settlement started on the problems visited upon us by illegal aliens.  I get about one question a quarter pointing out that these drivers do not care anything about our laws.  These are not "undocumented": they are here illegally, and cause hundreds of millions of dollars in costs to the rest of us.  I am all for legal immigration: I have sponsored two immigrants to work in the old law office because we needed legal secretaries who could speak the language of a large ethnic group in our county.  So I am fair minded on the immigration topic, but I would like the politicians who champion the cause of these illegals to spend some time seeing how they disrupt life here all citizens, both home-grown AND legal immigrants.  

OK, Stacy, I know that you did not tune in just to hear me on my soapbox!  In answer to your question, the status of the driver of the other car will not preclude the passenger from making a claim for damages if your fiancée is in fact at fault.  The passenger's status is in no way diminished by the illegal status of the driver of the vehicle.  

Even if the other driver had no license, that is not a defense to a claim of negligence to be brought by the passenger.  Obviously, if the other driver were to have been at fault, then the passenger would have no claim versus your fiancée.  

I would write this up and turn it over to your local office of Immigration and Customs Enforcement [ICE].  Make sure your congressional delegation gets a summary of your complaint—and ask him or her what they are going to do to stop this kind of abuse.
