i was rear ended the insurance co said im partly at fault willing to give me 25% of my damages why are they willing to give me money .im under a doc care treating for whiplash can i sue them

Insurance companies typically apportion liability between the 2 cars based on a percentage.  So what they're telling you is that you are 75% responsible and therefore they are only going to pay you 25% of your repair costs.  Sounds like a bunch of BS to me since any case that I handle which involves a rear end I apportion liability 100% to the car that did the rear-ending.  My guess is that they they see that you're representing yourself and are trying to pull the wool over your eyes.

It's pretty standard fare when insurance companies think they have someone on the other side of the claim that's not experienced in these matters.  I'd look for an attorney in your area and see if he/she will take your case.
