Mr.Cercone, I was involved in a no-fault accident and my car took almost 2 months to get back from auto shop because of parts that had to be shipped from Japan . The other party's insurance is telling me that they will only pay for 30 days. I have shelled out for car rental out of pocket. Can the insurance co .do this? What should I do ? I had an Lawyer but he says that there is no dollars in it for him so he mailed me the file and said see ya. Tim

As long as its the other guys insurance, they owe the rental car for as long as it takes, and as long as the delay was not due to some unreasonable action by you or the shop of your choice, UNLESS your state has some "no fault" law that limits 3rd party claims to 30 days of rental costs. Ask your lawyer, or look at the unfair claim practices laws in your state, or ask the rental car companies that cater to insurers, like Enterprise Rent a Car.
