Auto Insurance Claims: Being sued, monetary damages, ferraro

Hi
I had what I thought was a minor car accident in 11/09.  I am automatically considered 'at fault" because I hit someone from behind.  There was little damage and the driver refused medical treatment %26 drove her car away from the scene after the report was completed.  Well, I was served yesterday and I am being sued for negligence and they are seeking "monetary" damages.  This suit smells so frivolous to me that I can't stand it!  Do I have any options regarding proving or claiming that this suit is frivolous and the pure act of greed?
Also, I have a much bigger problem.  I own a 6 family property that I recently moved out of to prep it to put it on the market to sell.  Am I still allowed to sell the property now that I have this suit against me?  My husband %26 I are in our sixties and have been on unemployment for the past year, after losing our business.  As a result, this sale will help us to retire comfortably.  Are we allowed to sell?  Please advise!  Thank you!

I'm assuming you had insurance at the time of the accident.  Just let them handle it.  It sounds like a very typical hit-in-the-rear kind of case.  It'll probably settle for $7,500-$15,000 assuming low-level neck and back related injuries.  You shouldn't worry about it.  I know it probably feels very intimidating to be sued but it sounds like a pretty straightforward situation and your insurance company should be able to resolve it pretty easily.

You can absolutely sell the property.  It should have nothing to do with the lawsuit.
