Auto Insurance Claims: Auto damage claim, insurance, claim

I have two seperate claims from others hitting my car when it was parked. The insurance company made checks out to myself and repair shop but I didn't have repairs done before lienholder reposessed my auto. They auctioned it with the damage for a low price so of course I owe a deficit now and have two checks that I can't use. The lien holder has not asked for the money. What happens to the claims and the money now? Does my insurance have to reissue the checks to me since I now owe money as a deficit? WA state.

Well, if the lienholder is not asking for money, see if they will sign off on the checks. And don't you sign the checks before approaching them. You may need to consult a lawyer on this. I doubt that the insurer will reissue the checks without the lienholder named. You may have to pay the lienholder for their loss in value. Read your loan papers regarding insurance claims and repossesion with damage.
