QUESTION: Hi Jenny,

I am a UNC student. I had rented a car with Thrifty for 2 days. We went for a roadtrip and while returning I happened to fill the fuel tank with some diesel (not much, little) instead of petrol. I was too tired to see that I had done that. While returning the car stalled on the expressway, and I explained the situation to Thrifty. They got someone to tow the car and got us a new car. We reached Chapel Hill and went to the office to settle the claims.

They apologized to us that they haven't given us a new agreement. (when the cars were changed, no agreement was given to us) so they dint charge us then. After a month, I get a call from a very rude female and she asked me to immediately clear dues worth $1200 because of that. Is that legal? With no changed agreement? The rudeness put me off and I am considering an action against them.

What do you think should my approach. Also the car has LDW 3000 for it, so according to me any claim below 3000 should be paid by them, isnt it? Please let me know if my argument is valid. Thanking you in anticipation!

ANSWER: Without reviewing the contract, I can't guarantee my answer is 100% correct, but it seems you have the right idea.  If you purchased a Loss Damage Waiver for damages, then it seems you should be covered.  I am a little confused as to what the $1200.00 is for.  I am assuming it is a charge related to damages caused by the diesel.  

Your case is completely dictated by the original rental agreement.  If you want a detailed review for free, send us the rental agreement and we will let you know your options.

QUESTION: Sure. I have sent the agreement. Can you please let me know if its valid? There is no agreement for the change of car/new car though, which they accepted was their fault. They charged 1200 because they said since we filled diesel instead of petrol that damaged their engine. They told us such mistakes are not covered in any insurance.
