Auto Insurance Claims: not fault accident but MOT expired, personal injury insurance, juris doctor

my car was involve in a road accident where the other party was responsible for. At the time of the accident my MOT was expired, will  my insurance still help me to claim?, can the insurance of the other party refuse to take responsibility?

I should send back a response that this is out of my area of expertise since Dr. Settlement knows personal injury insurance claims ONLY in the United States, NOT in other countries.  But as I look around, I do not see any foreign country claim experts here, so I thought I would at least look up some items for you.  Unfortunately, what I found does not have even ONE reference to Italy.  

But I will pass along the links I did look at for you.  One thing you will see is that the opinions run both for and against you.  From this you should be able to build an argument that states the MOT is about the safety of the vehicle and since the safety of your vehicle was never in question in this accident, the lack of a current MOT is IRRELEVANT.  

That is the best argument I can come up with for you.  Sorry I could not find anything directly in Italy.
