Auto Insurance Claims: Medicare/Medicaid Subrogation, medicare medicaid, subrogation


Question
My brother, who has Down syndrome, was injured while a passenger on a city van. The city van driver is not at fault; the driver of the car that caused the accident is undisputably at fault. My brother sustained injuries for which Medicare & AZ Medicaid paid for treatment. When State Farm makes a settlement offer, will Medicare & Medicaid lay claim to the award? Thank you for any help/advice you can give me.

Usually yes. They will have subrogation of rights and be able to get the money back. However, there is some anti subrogation statues that forbid this in AZ. They might or might not apply to you. Contact a local lawyer and see if you can avoid subrogation on this situation.
