Auto Insurance Claims: Refuses To Process Claim, Refuses To Process Claim

While I was stopped at a red light I was hit in the rear and sideswiped by a car that was trying to pass on the shoulder to turn right. The other driver got a ticket for improper lane usage. This was on 11/26/09. I called the other insurance company and they said that they received all of my paperwork, but their insured has not,or will not fill out their paperwork. Until the driver responds they will not process the claim. So what should I do next to get the claim paid? The damage equals my deductible of $500, so I cannot get my insurance to help. If the other driver ignores the paperwork can their insurance company refuse to pay? If so what should I do to collect?

I know this is frustrating and not fair but insurance companies must ensure their client really did cause the accident and they really did do this. Sometimes a police report is enough, sometimes it is not. You can try to also contact the department of insurance of your state and see what they say.
