Auto Insurance Claims: car accident, left hand side, edited version


Question
i had an accident at a mini roundabout, my right there is no road only residential, 3rd party came out of left hand rd.i was going straight over.my right of way.

she claims she was on the same road as me(potentially in front of me or besides me!)and was doing a U-turn back on herself.my damage is to passenger side lights,wing and area over wheel.i did not see her at all only heard crash.her damage is on drivers side corner.i have witnesses and passenger in my car.she was alone.3 yrs down the line just before court hearing she produces dvd of a wedding (she had supposedly been to) and it shows her coming down the road i was on and then cuts to the guests in front of a house 6seconds pass and you hear a 'crash'.you did not see me pass or anything else.this is final edited version of dvd.potentially, other party claim is that she did not come out of left hand side road but was on the same road as me.

mini roundabout is same length of a car.on the dvd you see her get to the 'entrance' of roundabout and 6seconds pass before 'sound of crash'. am i right in thinking this does not 'prove anything'. im not in it, it is an edited version and if it took her 6secs to go round the roundabout and only make it to the '1st exit' she is now in the left hand side road, hence i didnt see her and she had to then 'giveway' to the person on her right.??

i did a test run and at most it would take about 2/3 seconds to go straight over the roundabout, in which case her car would have been hit in the middle not on her front lights. any help would be great.

Hi Emma,

This is a very difficult situation for me to determine who is at fault. Without being able to have a statement from the other driver or see the video, I can not say.

However, If this is going to court, you should absolutely contest the video because the other driver as you said, may have edited the video. You will just have to tell your side to the insurance company and/or the judge and see what happens.
