Can I make a diminished type claim?

Answer
Absolutely, you have a right to file a diminished value claim. Anyone whose car is damaged due to the negligence of another is able to file a DV claim with their liability carrier. Depending on the state in which you live and that state's insurance department, you can expect varying degrees of cooperation from the other party's insurance company. Be aware that their insurer has no legal duty to you, but their policyholder does, so that is where you apply the pressure. Go to www.ICAN2000.com and search for local DV help and you will probably find someone there to assist you in the claim.
