Auto Insurance Claims: Loss of use and Cant find my Attorney, diminished value, georgia law

Question
Greetings Ernest

My question is in the state of georgia can I recover loss of use monies in regards to my accident. My insurance company only offered me a $20.00 a day rental plan if I were to get a rental car. M y accident happened on 9/21/09 and as of today I am still without a vehicle I was laid off prior to the accident so I did not need to rent a car i just used the second vehicle we have. So since I did not get a rental am I entitled to any monies due to my loss of use on my car other than diminished value. My next question I was working with attorney and just last week I had to send him a letter of release because he would n ot answer my calls or letters I am ready to move on with my case but I can't find him the insurance company is ready to settle my claim but they said they can not talk with me until they get the release letter from the Attorney we are stuck in motion. I have called him several times and no response I do not know what I can do the Attorney is holding up my closure and settlement on the claim.

Answer
Mike,

I'm not familiar with Georgia law since I'm only licensed in NY.  However, you're probably not entitled to the rental payment unless you actually rented a car.  You might be able to get them to pay for the wear and tear on your 2nd car but that would be minimal.

As far as finding your attorney... I'm not sure what to tell you on that one.  There are typically various state and local Bar Associations that attorney's belong to.  You might want to reach out to one of them and see if they have any luck in finding him/her.  But give him/her a few weeks to respond - especially around the holidays - things can get very hectic.

Best regards,

Ernest Ferraro.
