Auto Insurance Claims: parking lot accident, parking lot accident, own insurance


Question
My question is about Florida no-fault, my vehicle was recently hit by another in a parking lot, it was legally parked and no one was in it. The question is, in Florida, is the legally responsible persons insurance liable for my vehicles repairs? I have tried to find the answer online but all I get is stuff about accidents with bodily injuries. A link would be fine.

Hi Bill,

The term "No Fault: in the state of Florida only applies to injuries. It simply means that regardless of fault, the first $10,000.00 in medical bills is paid by your own insurance company. It has nothing to do with damage to vehicles.

If someone else was at fault for the damage to your car then they (or their insurance company is respponsible for the cost of repairs to your vehicle. If you do not know the identity of the at-fault person as in the case of a hit and run, then you would have to make a claim under your own collision coverage if you have that coverage.
