Auto Insurance Claims: Is this the end?, own insurance, leftside

I was in accident on 10/22/09 it was on a busy street that has a gas station I was in the turning lane getting ready to head into the gas station however there was a truck coming out of the gas station. The owner of the truck first was on the left side and the he bagged up and switch to the right side and was looking to right as if he was going to turn right. Seeing this I prepared to enter the gas station on the left side once traffic cleared. However I was pulling in on the leftside when the driver pulls out without even looking into my direction and goes to the left instead of right and hits my car. We got out the car and the driver said I ran right into him and then said what do we do now??? I told him we have to call the police. I call the police and the police told me to move my car since it was on a very busy street in the city and get hit again so we moved both vehicles. When the cop got there he first talk with the man and then came and look at my damage and spoke with me. He said based on what he saw he could not rule either driver liable and that no one would get a ticket because he could not determine who was at fault. He said that we each would have to file with our own insurance if we chose to. While the officer was writing the report the owner of the truck kept asking for my insurance information. However I stated I would feel more comfortable letting the officer take the information and swap it which the officer did. However when the officer came back to swap the info he stated there was not way I could have hit him based on the damage to my car unless I was intoxicated or started back from a farther distance speeding like a mad woman based on looking at the damage so it seems it felt the other driver was at fault but neither of us got a ticket. Well to end this situation I got into my vehicle and left and the other man was there with the cop getting his vehicle towed. I am not planning on turning the accident in to my insurance because I know someone with a body shop who can fix my vehicle for cheaper than my deductible. My question is: Is this the end of this situation being that neither party was held liable? Can the guy try to say I hit him and try to sue or something?

Answer
The other driver can sue you at any time. In fact, anyone can sue anybody for just about anything. It is just a matter of what you can prove in court. If you have witnesses to support your side of the story, then you may be all right. Without a citation from the police to show fault, neither one of you has a very strong case.
