Auto Insurance Claims: husband rear-ended @ carwash, responsible party, insurance company

I also have the same problem as the previous person, with my husband just being rear-ended yesterday @ the Brown Bear Carwash.  The car wash mgr. is of course denying blame, but I think they either spaced the cars too closely together, or else the mechanisms that hold onto/push the cars through are defective.  My husband's car rec'd damage, but of course the guy behind him did not.  Both drivers had their cars in neutral....then they suddenly collided.
It seems there must be something insurance companies can do in this situation - after all, they are paying to fix the car - I would imagine this happens more often than we hear.  Can you provide any other suggestions, as we don't want this claim on our ins. or pd. by it.    Thank you, Shan

Hi Shan,

The only thing you can do is to file a claim with the car wash or their insurance company. If they refuse or deny the claim then you can either file the claim with your insurance company or file a law suit against the owner of the car that hit you and the car wash. If you file with your insurance company and they feel you were not responsible, they will pursue reimbursement from the responsible party.
