My vehicle was involved in an accident, prior to the accident, my car had 4 matching rims, One of the rims was damaged due to the accident. The one rim has been discontinued and a replacement cannot be found. I am disputing that prior to the accident my car had four matching rims and I want the insurance to put 4 matching rims on my vehicle. The insurance is denying the supplement of 4 rims. What can I do?

Tell the adjuster that you will be filing a diminished value claim on the basis of how their company paid the claim. They may have excluded DV losses from your first party benefits, which would rule that out.

I assume the accident was your fault, in which case you have the option of enacting the appraisal clause within your policy, a mechanism in all insurance contracts to resolve disputes over the amount of the loss. If you enact the appraisal clause, you pick an independent appraiser, the insurer selects their own, and the two designate an umpire to make a binding decision. You (the insured) are responsible for the cost of your appraiser and half the cost of the umpire.

If the accident was not your fault, your remedies are easier to do. Inform the at-fault party's insurance company that you will pursue legal means against their policyholder to be made whole. Send them the notice via certified mail with return receipt.
