Auto Insurance Claims: Settling a claim, Settling a claim

Question
I have been going back and forth with a rep from an insurance company whose insured broadsided my car when I was at a stoplight and totaled my car. Fortunately no serious injuries, but I have had lingering pain from tendon strain in my thumbs and wrists due to gripping steering wheel on impact. At first the insured was not offering to even cover my med bills. After much writing back and forth providing document they now at least are doing that, but are providing nothing for "pain and suffering". The other driver was at fault and medically unfit. Is it worth it for me to pursue Small Claims Court to gain an amount to cover possible further treatment? I want to end and resolve this. Thanks!

Answer
Hello Todd,

I am sorry to hear about your injuries. Well, Small claims can be a good forums under limited circumstances. Please see: http://www.auto-insurance-claim-advice.com/small-claims-court.html

You want to make sure that your injuries are totally taken care of or you will end up with a jury award that cannot be reopen.

You will want to talk to an attorney about that. You will however finish the claim, if that is was you would like.

I hope this helps

Good Luck,
Anne
