Auto Insurance Claims: 2 cars reversing in parking lot, minor accident, rear seat

Hello, My husband reversed in a store parking lot at the exact same moment as a woman was reversing out of her space behind him.  They did not see each other and 'bumped' each other.  they both called their insurance companies and we assumed a 'knock for knock'.  However, we now learn that my husband has been declared 100% liable and our insurance has paid for her claim!  We did not claim. Should we take this up with our insurance?  Should my husband now claim against her for the slight damage to our car?  My husband did tell our insurance that she was distracted by a dog in the rear seat of her car, but this obviously made no difference.  How can this minor accident be 100% my husband's fault?  He is being penalized for being 'Mr Nice Guy'.

Hi Jane,

Your husband needs to call his insurance company and vigorously object. This accident should have been decided to be 50/50 liability. Each person was equally at fault.

Unfortunately, in the end it may do no good since they have already paid for the other car.
