Auto Insurance Claims: Denied claim, insurance expert

Question
My auto insurance with infinity denied my claim because they had found out that my brother that got into accident was residing with me. Is there any change I could make them pay the property damage?

Answer
Hello Bea,

I don't have all your details, however I am going to assume that when you completed your application for insurance you did not disclose your brother who was residing with you.  This affects your insurance company from properly evaluating the risk. Simply stated, risk is the major deciding factor in determining if you will be accepted, and at what rates.  If you fail to disclose pertinent information when you apply, then not only will your claim(s) be denied, but you are also likely to have your policy revoked, with a return of premiums paid.

Failure to disclose pertinent data, and/or misstating facts is called misrepresentation.  That said, no, there is no chance they will pay for the property damage.

If you did not misstate on the original application, you might have a case.  It depends on the language of your policy.  In that case, you would be advised to seek a legal opinion.

Sorry for the bad news.
