Auto Insurance Claims: Engine Replacement, florida insurance company, core charges

I just had my engine replaced as a comprehensive claim because it hydro-locked during a bad rainstorm. The Florida insurance company replaced the blown motor with a new one because it was more cost effective than a used motor by $2600. I asked to have my blown motor given to me because there was no core charge and the dealer was going to junk the blown motor. At first the claims adjuster had no problem with that but when I called the dealer to make arrangements to pick up this motor I was told my claims adjuster was wrong in releasing it to me and now no one wants to agree. It seems the dealer has another customer for my engine and I don't want anyone to profit off my misfortune. The claims adjuster was concerned I would take my blown motor and reinstall it into my car and then file a duplicate claim. I told him there is a serial number off of the motor that the insurance company could record and then deny a new claim for that serial number on the motor. Obviously he did not like that simple solution and now the dealer and claims adjuster are playing hard ball. Am I entitled to my blown motor?

Yes, you are entitled to have all replaced parts returned to you at your request. In fact, some states have laws that say a repair shop must present you with the old parts are your request. Evidently there is some value to your old motor and if there are no core charges for the replacement part, then that part is yours.
