Auto Insurance Claims: My claim, small claims court, electrical failure

Question
My car caught fire from another truck parked beside my car.Fire investigator told me that truck got in fire due electrical failure(cruise control switch FORD F150).So I filled claim with insurance company(Direct General) truck owner insurance because I did not have insurance my car was for sale and I did not use that car. After 5 weeks claim adjuster supervisor told me that they will not pay claim because the owner of the truck not caused fire and they said that is no proof that he was negligent to cause fire.I am very upset thinking if my car was like 4-5k it will happened same thing IT IS NOT THEIR FAULT.My car worth about $1500 but is it still my money and I think somebody should pay.So please any advice on this type of claims

Answer
Erwin,

The cause of the damage to your vehicle was the fire of the truck parked next to it. However, the liability carrier has no legal duty to you and can arbitrarily deny your claim. This does not get the owner of the truck off the hook, so you can take that person to small claims court. Let the insurer of the truck know that you will pursue this matter in small claims court and will file against their insured party. That may get some action on their part, but at the very least the court will resolve the matter in your favor.
