Auto Insurance Claims: Wondering, valueable, peace of mind

Question
Hi,

I was involved in a car accident in January 2007, I was not at fault. Right before the 2 yrs statue expires, the other insurance offered me $5,000 and a letter from their expert saying that my injuries are "highly unlikely" cause by the accident. I hired an atty who hired an expert who wrote that it is "highly medically probable". At this point, do you think the insurance company will still fight my case? If so, how long do you think it will take before it get resolve?  It's been over 2 years and I want to move on with my life. I haven't been working due to this accidnet and I don't know if I will ever be in the future. I am done with the treatment and my disability is permanent.

Thank you in advance for your inight to help me get a peace of mind. I am getting depressed and cannot sleep over this. I want it to end.

Answer
Hi Grace,

I'm sorry for your difficulty.

The insurance company will likely continue to fight. They will take the position that their expert is correct and of course, your attorney will take the position that your expert is correct. You should really be asking your attorney how long this may take as he is obviously much more familiar with your case, your injuries and your treatment than I am. I have seen some injury claims drag out for years. How long it ultimately takes will depend how far appart your demands are compared to what the insurance company wants to pay. It will also depend on your ability to hang in there and let your attorney do his job. The older your claim becomes, the more valueable it becomes.

I hope this helps
