Auto Insurance Claims: accident, compensation insurance company, workers compensation claim

I was in an accident where I was a passanger I recieved moast of the injuries the man that was driving was going after his cell phone not paying attention to his driving.I also work for this man we were on our way to work his insurance company says that there is a clause in his insurance that they don't have to pay employees what is my recorse I have hospital and doctor bills .

I'm not sure I understand the exclusion for not paying for employees except as follows: If you were on your way to work and not actually "working" at the time of the accident, then this exclusion should not apply. When you are commuting to or from work you are not actually on company time and at that point are not technically an employee. If you were actually working and on company time then this would be a workers compensation claim and should be filed with the employers workers compensation insurance company.

In either case your medical bills should be covered. As a last resort you can always submit the bills to your regular medical insurance if you have any.
