Auto Insurance Claims: insurance claim, repair estimate, insurance claim

Question
I was rear ended by a car after he was rear ended,  My truck rolled over in the accedent.  My truck has only liability so my insurance tells me I must represent myself.  Which company should I make the claim against, the guy who hit me or the guy how caused the accedent?  Should I get a lawyer?

Answer
H Kim,

You shoulkd file the claim with the insurance company of the person who initially caused the accident. There is no need for you to get an attorney until or unless the insurance company does not treat you fairly.

Report your claim to them, they will have a damage estimator inspect the damage and write a repair estimate. If the vehicle is repairable then you should select a body shop to do the repairs. If the repair estimate is 70% or more of the value of your vehicle, the insurance company will likely declare it to be a total loss in which case they will pay you the value of the vehicle and they will take the vehicle and sell it for salvage.

I hope this helps
