Auto Insurance Claims: parking lot accident, parking lot accident, ariel photos


Question
While in a parking lot travelling in a lane, the other party drove through an area of parking stalls and T-boned my car. The other party is now denying the area of point of impact and not taking responsiblity for the damages to my car which are estimated at CA5000.00. Both insurance companies have agreed to settle the claim 50/50. Which is unfair to me as I am in no way responsible for mine nor their damages... I have send ariel photos of the parking lot to show the point of impact and that indeed there is parking stalls there and not a lane or thouroughfare. Any idiot would be able to see from the damages to my car that I was hit by someone else. Why should I have to yield to someone who is cutting through an area which is not a lane of traffic but a designated area for parking at a busy mall?
Any help and advice would be most appreciated.
I am currently looking into any video surveillance that any nearby stores/businesses may have from that day.

Hi Steph,

Unfortunately, without the video or an independent witness this is a case of he said she said. In these type of cases the insurance comapny has not choice but yo find liability at 50/50. You may want to ask the mall management itself if they have video of the area on the day of your accident.
