Auto Insurance Claims: Fault and Liability, Fault and Liability, damages

Question
I've been waiting for two weeks regarding my Liability
Does it take this long for the other insurer company to release my check?  How long does it take for the to determined who's at fault?  NOTE: I was in a parking stopped, stopped waiting to make a left turn.  A car start coming out and I blew my horn but it kept coming.  It hit me on my sliding door all the way towards my back bumper.
Their was one witnessed.  My car was damaged bad.  She only had a scratch on her car.  The Law in MD states you must back our your car in parking lot slow, look at your mirror for on coming cars.  My Daughter ask her why she did
not stop when she hit me she said she did not see me.  I ask her did she keep going.  Then she did not answer.  She started writing down my tag number.  I told her I'm going to call the police.  She got scared and sat in her car.

Answer
Hello Pam,

Insurance companies have up to 30 days to make a determination on fault. Many insurance companies wait until they have their insured version of events before making a determination. If their insured has  a different story and there is no evidence against their insured (an independent witness and/or a police report), the insurance company might not give you a check. They can simply deny liability. If that is the case, the you either involve your insurance company and go to arbitration or get an attorney.

To answer your question, they have up to 30 days, After that, they can deny liability if they do not want to pay. Looks like you have a clear case based on the facts you wrote above, therefore, you can probably get paid any time before 30 days.

Good Luck
Anne.
