Auto Insurance Claims: Parking Lot Accident Liability, parking lot accident, side doors

Two Months ago I was reversing out of a stall in a one way narrow parking lot. I was properly looking over my right shoulder and proceeded with caution while in reverse and immediately stopped when I felt a crunch behind me.  The car that was driving by was very low to the ground (I am in a large truck) and was not visible to me.  There was no damage to my truck but there was a long scratch that went lengthwise across the other drivers front and rear passenger side doors.  While speaking to the other driver, he made a comment stating that he had noticed my truck and wondered why the parking lots were so narrow prior to the collision.

My insurance company just presented me with a letter stating that they have determined I am 100% at fault because I failed to maintain proper lookout while backing and struck a vehicle.

Heres the kicker... my claim adjuster never called me to take an official statement.  I reached out to the adjuster and stated that I would like to give my statement and provide pictures and received a message back stating that they have all the information they need and that it would not be necessary.

Do you believe that I should be 100% at fault here?  What can I do about my insurance company not taking my side of the story as well as the pictures that I have?

Hi Tony,

Yes. You are 100% at fault in this situation. Anytime you are backing from a parking space and hit another vehicle you are considered to be at fault.

The fact that the adjuster did not take your statement is unusual, but would not change the fact that you are liable. It is possible that they had someone go out to inspect the damage to the other vehicle and based on the damage the only conclusion was that you were at fault.
